These Terms of Service (“Terms”) govern your use of the Timerist mobile application operated by Domain Licensing LLC, doing business as Timerist and Workoutist (“Timerist,” “Workoutist,” “we,” “our,” or “us”).
These Terms apply specifically to mobile versions of the Timerist platform distributed through application marketplaces such as the Apple App Store or Google Play Store.
The Service includes:
- the Timerist mobile application
- associated mobile features and services
- integrations with mobile operating systems and devices
(collectively, the “Service”).
By downloading, installing, accessing, or using the Service, you agree to these Terms.
Acceptance of Terms
By downloading, installing, accessing, or using the mobile application, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you must discontinue use of the Service.
Electronic Acceptance
During account creation or sign-in, users may be asked to confirm acceptance of these Terms by selecting a checkbox or clicking an agreement button.
Language presented during registration may include statements such as:
“By creating an account or signing in, you agree to the Terms of Service and Privacy Policy.”
Such action constitutes your electronic agreement to these Terms.
Eligibility
You must be at least 13 years old to use the Service.
By using the Service, you represent that you meet this age requirement.
User Accounts
Certain features of the Service may require users to create an account.
Users are responsible for:
- maintaining the confidentiality of login credentials
- ensuring account information remains accurate
- all activity occurring under their account
Timerist reserves the right to suspend or terminate accounts that violate these Terms.
User Content
The Service may allow users to create or store timers and workout routines.
Users retain ownership of the content they create but grant Timerist a limited license to store and display such content as necessary to operate the Service.
By creating/submitting/importing/exporting/loading/using/sharing/viewing/completing User Content (custom timers/workouts), you grant us a perpetual license to collect/track/analyze events related to it (including creation with creator attribution, imports/exports/loadings/usages, failures), retain anonymized/aggregated data indefinitely for trends/popularity analysis/reporting/articles, feature content with metrics (e.g., import counts), and use aggregates for improvements/insights. This includes creator-linked data anonymized for public metrics. License includes tracking events (creation with attribution, import/export/loading/usage), indefinite anonymized retention for trends/articles, featuring with metrics.
Analytics and Service Improvements
We log activity events (e.g., creation/modification/import/export of workouts, logins, profile views, failures) to analyze usage, troubleshoot, and determine content popularity. See Privacy Policy for details. Aggregated/anonymized data may be retained indefinitely and used for trend reports or features without identifying individuals.
Prohibited Conduct
Users may not:
- reverse engineer the application
- attempt unauthorized access to accounts or systems
- use automated bots or scraping tools
- interfere with operation of the Service
- use the Service for unlawful purposes
Violation of these rules may result in account termination.
Exercise Disclaimer
The Service provides digital timers and workout utilities only.
Timerist does not provide fitness coaching, medical advice, health monitoring, or professional instruction.
Users should consult a qualified physician before beginning any exercise program.
Assumption of Risk – Physical Activity
Exercise and physical training involve inherent risks including injury.
By using the Service in connection with physical activity, you voluntarily assume all risks associated with exercise.
Not a Medical Device
Timerist and Workoutist are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Timer Functionality Disclaimer
The Service provides digital timers, interval timers, countdowns, and audio alerts designed to assist with workout timing.
While we strive for reliable performance, Timerist does not guarantee that timers or alerts will be uninterrupted, error-free, or perfectly accurate.
Timer functionality may be affected by device performance, operating system behavior, battery levels, software updates, or other factors beyond our control.
The Service should not be relied upon for safety-critical or medical timing purposes.
Timer operation may also be affected by background application behavior as described below.
Background Application and Device Interruption
Timer operation may be affected by device or operating system behavior.
Examples include:
- locking the phone screen
- switching to another application
- incoming phone calls or notifications
- battery optimization or power-saving modes
- operating system restrictions on background processes
Timerist cannot guarantee uninterrupted timer operation when the application is running in the background.
Users are responsible for ensuring their device remains active while using timers during workouts.
Interval Timer Monitoring Responsibility
Users are responsible for monitoring their own physical condition during exercise.
Timer alerts, audio cues, or interval notifications may occasionally be delayed or interrupted.
Users should not rely solely on timer alerts to regulate workout intensity or rest periods.
No Warranty of Fitness Results
Timerist does not guarantee any specific fitness results, performance improvements, calorie expenditure estimates, weight loss, strength gains, or other training outcomes.
Individual results vary depending on factors outside our control.
Advertisements
The mobile application may display advertisements through third-party advertising services including Google AdMob.
Third-Party Platform Disclaimer
If you access the Service through an application distributed via the Apple App Store or Google Play Store, you acknowledge that:
- these Terms are between you and Domain Licensing LLC, not Apple or Google
- Apple and Google are not responsible for the Service or its content
- Apple and Google have no obligation to provide maintenance or support services for the application
Apple and Google may be considered third-party beneficiaries of these Terms where applicable.
Limitation of Liability
To the maximum extent permitted by law, Timerist shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.
Governing Law
These Terms are governed by the laws of the State of Missouri.
Any disputes shall be resolved in the courts located in Platte County, Missouri.
Changes to These Terms
We may update these Terms periodically.
Continued use of the Service after updates constitutes acceptance of the revised Terms.
